Please note that by ordering our products, you accept these conditions of sale. If you do not accept these conditions of sale, you will not be able to order our products. Sales concluded through shops are not subject to these conditions of sale.
At any time, we can update these conditions of sale. When we do, we will post the changes on our website. They will take effect immediately upon publication. By continuing to use our platforms, you agree to be bound by the terms of these changes. Any changes made to the conditions of sale after your orders will have no impact on said orders.
Only individuals (and not legal entities) who have reached the age of legal majority required to conclude contracts, who have the legal capacity to conclude contracts and who use a shipping address in the countries that we market as indicated on our platforms, can order our products. By ordering our products, you represent and warrant that you are a bona fide end customer making a purchase for your own use or for the personal use of a third party, and that you will not deliver, sell, or distribute any other way our products, nor will we buy our products or services for commercial purposes.
All orders placed through our platforms are subject to availability and our acceptance of said orders. The products presented on our platforms, which cannot be added to the basket, are not available for sale. Quantity limits may apply to orders for our products. We reserve the right to refuse at any time, without notice, orders exceeding a certain number of authorized products.
The ordering steps for our platforms include the following steps:
Add to basket
Once you have chosen a product, you can put it in your basket. You can then decide to continue shopping and add them to your basket (subject to availability and quantity limits). Putting an item in your basket does not guarantee its availability at the time of purchase, which is only confirmed after you have received a written order and shipping confirmation.
Validation of purchases
When you are ready, you validate your order. You can also remove from the cart one or more products that you selected during the validation process.
Delivery, verification and payment

Acceptance of order

If an order is placed by phone, a Poincaré Watch advisor will guide you through the above steps and ask you verbally to confirm the details of your order.
We reserve the right, in our sole discretion, to refuse, cancel or terminate orders at any time for reasonable reasons. For example, we may refuse, terminate or cancel your order in the event of pending litigation concerning payment for a previous order or if we suspect you, in our sole discretion, of fraudulent activities or any another kind of violation of these conditions of sale.
The prices indicated for our products on our platforms indicate, unless otherwise stated, whether they are with or without sales tax / VAT. They exclude delivery costs and all other taxes. In most cases, delivery costs are included in the sale price. Contact us if in doubt.
The applicable currency will be updated according to the delivery destination after you provide us with the delivery address and will be mentioned on your basket before you place your order. You will need to carefully check the updated prices as well as the applicable currency. Sales taxes or usage taxes will vary depending on the place of delivery of our products. We reserve the right to change prices and delivery costs at any time without notice.
We ensure that product prices and delivery costs are correct when the relevant information has been entered into the system or has been indicated to you on our platforms. However, despite our reasonable efforts, it is still possible that the price of some of the products indicated is not fair. If the price of one of the products you order or the delivery costs are incorrect, we will contact you as soon as possible to inform you of this error. If we are unable to contact you using the contact details you provided during the ordering process, we will cancel the order and not notify you in writing. If we accept your order in error and process it when an error occurs in the prices indicated or delivery costs, we may cancel the supply of the product and refund the sums you have paid.
Please note that changes to the law in force between the date of placing your order and the date of receipt of a written order and shipping confirmation may change the taxes associated with your order. If the resulting change results in higher taxes charged to you, we will contact you and ask you to confirm your order again.
We accept the means of payment identified as part of the order process on our platforms. When ordering on our platforms, you must indicate your payment details on the appropriate form. In the case of an order placed by telephone, you must provide your full payment details. All payment card holders are subject to a validation check and an authorization procedure by the card issuer. If your credit card issuer refuses to authorize payment to us, you will need to contact them directly to resolve the issue.
You expressly authorize us to perform security checks if we deem it necessary, to transmit or obtain information from time to time, including updated information about you for or from third parties, including but not limited to , the details of your payment card, in order to authenticate your identity, validate your payment card, obtain an initial payment card authorization and authorize individual purchase transactions. The total amount of your purchase will be debited from your payment card at the time of your order.
We can accept any bank transfer as payment for orders at our sole discretion. Some banks may charge bank transfer fees. We require that all orders paid by bank transfer and placed over the phone be confirmed through an order approval process. We can acknowledge receipt of an order paid by bank transfer, but the order will not be processed until we have received payment and we have confirmed receipt by email. If your bank transfer is not credited to our bank account within seven (7) days of placing your order, your order will be canceled.
Once you have made your choice and placed your order from our platforms, you will receive an order acknowledgment by email. Keep this order reference number for future inquiries regarding your order. This order acknowledgment does not constitute acceptance of your order. Upon receipt of the order acknowledgment, it is your responsibility to check it and confirm that it accurately reflects your order intentions. If you have any questions or if the order acknowledgment does not reflect your intentions, you should contact us as soon as possible. We will send you an order and shipping confirmation by email when your order is shipped. This order and shipping confirmation constitutes acceptance of your order from us, indicating the existence of a binding sales contract.
After ordering products from our platforms, you will receive an invoice on the email address indicated during your order.
We only accept orders to be delivered to the countries indicated on our platforms. Please note that we do not ship to certain addresses, such as collection points or PO boxes. Withdrawals from our partner stores may be offered in certain locations. Please contact us for more information. We will notify you by email when the product is ready to be picked up in store. We will use reasonable efforts to ensure that delivery is made by the carrier within the estimated delivery times from the date of our written order and shipping confirmation, and in any case within thirty (30) ) days after that date.
If the delivery of products is delayed by an event beyond our control, we will notify you as soon as possible and use all reasonable efforts to minimize the consequences of the delay. If we do not deliver within thirty (30) days of the date of the written order and shipping confirmation or any other time period that we indicate, you can contact us to cancel the order and get a refund of the amount paid related to products you have not received. In all cases, your right to cancel an order and receive a refund of the amount paid related to the products that you have not received constitutes your only recourse if we do not deliver the order in question.
When evaluating your delivery time, please take into account payment approval, address verification, security checks, order processing and the specified delivery time. Please note that delivery is always subject to receipt of your full payment.
We will require a valid signature from you, or from any person at the specified delivery address, to confirm delivery of the products, after which the risk and responsibility for the products you have purchased is transferred to you. If you have indicated a recipient other than you for delivery, for example a gift, you understand and accept that a signature of said recipient or of a person at the delivery address constitutes proof of delivery and payment of the sales contract by Poincaré Watch, implying a transfer of responsibility to the recipient’s address, as if the product had been delivered to you.
You have the right to cancel the contract without giving any reason within fifteen (15) days from the date on which you acquire, or any person you name, acquires physical possession of the products in your order. If you are a customer located in the European Union or in the European Economic Area and you have made a purchase from our platforms, this is considered your legal right of withdrawal. In order to respect the withdrawal period, you simply have to withdraw before the expiry of the said period. To cancel the contract and return your products, you can contact us by email, clearly indicating your position. You must ensure that we have received your request.
To return a product to the distribution center of our e-store, you will need to contact us by email, agree on a withdrawal date with our logistics partner, we will send you a return form by email. You will need to fill in the information requested on the return form and sign it. You must include in the packaging the return form completed with the product and all of its accessories, in their original box. You will need to keep proof of the return shipment, and we accept no responsibility in the event that you are unable to provide such proof. Only products received by Poincaré Watch, under the aforementioned conditions, may be eligible for a refund. We will verify that the returned products meet the conditions for returns before proceeding with the applicable refund.
Our products must be returned in new condition, with all the protective materials in place and accompanied by the labels and stickers affixed to it, as well as the original box and packaging, including all of the accessories. and documents. We reserve the right not to accept any returns if the product shows signs of wear, or has been used or altered from its original condition in any way or, we may reduce the amount of any reimbursement applicable accordingly.
Returns will be subject to rigorous quality control to ensure that the returned products comply with our quality requirements. If the products do not meet the control standards, we will refuse the return and the products will be returned to you. If the returned product satisfies the check, we will refund within a reasonable period of fifteen (15) days, unless unforeseen.
Failure to comply with these conditions of sale gives us the right to refuse the returned product and return it to you, at your expense.
We are committed to ensuring that each product strictly meets our quality criteria and that it has met all of our controls, both technical and aesthetic. The selected products are covered by the applicable Poincaré Watch guarantee. As a consumer, you may have legal rights under the applicable legislation governing the sale of consumer goods; these rights are not affected by these conditions of sale or the applicable Poincaré Watch warranty.
We make every effort to ensure that the descriptions and visuals of the products indicated on our platforms, communication media or press are accurate and exhaustive. However, we make no warranty, express or implied, as to the accuracy, reliability and completeness of this information.
Nothing in these conditions of sale limits or excludes our liability in the event of liability which cannot be limited or excluded by applicable law. Subject to the preceding sentence, our total responsibility to you in the context of these conditions of sale for any order, whether contractual, tort, due to negligence or otherwise, even if we have been informed of the possibility of said damages will in no case exceed one hundred percent (100%) of the price of the products in your order.
In some countries, consumer protection legislation does not provide for exclusions or limitation of warranties or liabilities. In fact, some of the exclusions and limitations may not apply.

This contract is concluded between you and us. No other person will have the right to enforce any of its conditions. However, if you buy a product as a gift, the recipient of your gift will benefit from the applicable Poincaré Watch guarantee.
These conditions of sale will be governed by and interpreted in accordance with Swiss law. You can initiate proceedings against us before the courts of the Canton of Geneva. We can also initiate proceedings against you before the courts of the country where you are domiciled.
